TERMS AND CONDITIONS OF RENTAL
These Terms and Conditions govern all reservations, rentals, and related services facilitated by Wanda von Breisky Unipessoal Lda, trading as CadenzaLux, a company registered in Portugal (hereinafter referred to as “CadenzaLux”, “we”, or “the Agent”).
CadenzaLux acts as an intermediary and representative of property owners (“the Owners”) who offer their properties (“the properties”) for short, medium, or long-term rental to guests (“the guests”). By making a booking, the Guest acknowledges and agrees to these Terms and Conditions, which form a legally binding agreement between the Guest and CadenzaLux acting as agent for the Owner.
RENTAL DEFINITIONS
- Short-Term Rental: One (1) night up to thirty (30) nights.
- Medium-Term Rental: One (1) month up to twelve (12) months.
- Long-Term Rental: Over twelve (12) months up to three (3) years.
Each booking represents a temporary license to occupy the Property for the agreed period. Nothing herein shall create a landlord–tenant relationship, nor confer any tenancy rights upon the Guest.
BOOKING REQUIREMENTS AND PAYMENT
To confirm a reservation, the Guest must provide:
- A valid passport or government-issued identification; and full payment of the rental amount and security deposit no later than one (1) month prior to check-in.
If these conditions are not met, the reservation may be cancelled without refund.
PAYMENT TERMS
All payments must be made in full prior to occupation. No access to the Property shall be granted until all due amounts are received.
Owners may impose their own payment or cancellation policies, which shall prevail where stated in the rental agreement or property listing.
TOURIST TAX
A local tourist tax per night, per guest, is payable in advance. The value and applicable minimum nights vary depending on the Property’s municipality or location.
TRAVEL INSURANCE
Guests are strongly advised to obtain comprehensive travel insurance covering cancellation, curtailment, personal injury, property damage, and third-party liability for the duration of the stay. CadenzaLux accepts no responsibility for loss or damages arising from failure to obtain insurance.
GUEST OBLIGATIONS
GUEST INFORMATION
All Guests must provide contact details and arrival information.
The number of occupants must correspond to that declared at the time of booking. Any change in occupancy or inclusion of pets must be approved in advance by CadenzaLux or the Owner. Additional charges may apply.
GUEST CONDUCT
Guests shall behave respectfully and lawfully. Noise must be kept to a minimum between 22:00 and 09:00.
The holding of parties, events, or commercial activities is strictly prohibited unless expressly authorised in writing by CadenzaLux.
GUEST RESPONSIBILITY
The lead guest (“the Principal Guest”) is responsible for all individuals in the party and for any visitors to the Property. All Guests are jointly and severally liable for damages or breaches of these Terms.
MINIMUM AGE
Certain properties have a minimum age requirement for the Principal Guest (e.g., 26 years old). This will be notified prior to booking and must be respected.
CHECK-IN, CHECK-OUT AND ACCESS
- Standard Check-In: 15:00 to 20:00
- Standard Check-Out: 10:00
Guests must contact CadenzaLux no later than 72 hours before arrival to confirm check-in arrangements.
Check-ins after 20:00 are subject to a fixed charge of €80, payable in cash directly to the person facilitating the check-in. This fee applies per arrival.
EARLY OR LATE CHECK OUT
Requests for early check-in or late check-out must be made in advance and are subject to availability and an additional fee.
CadenzaLux and its representatives reserve the right to access the Property for emergencies, repairs, or inspections, with prior notice where practicable.
SECURITY DEPOSIT AND DAMAGE
A security deposit is required to cover damages, missing items, or additional cleaning.
If no deductions are necessary, the deposit shall be returned within five (5) working days of check-out, subject to receipt of correct banking details.
If damage, loss, or misuse occurs, CadenzaLux will notify the Guest within seventy-two (72) hours of departure and provide documentation within fourteen (14) working days.
Any shortfall beyond the deposit amount remains the Guest’s responsibility.
Guests must report any damage immediately upon discovery, whether caused by themselves or occurring otherwise.
USE OF PROPERTY AND HOUSE RULES
PROPERTY ITEMS AND ACCESS
All furnishings, equipment, and contents belong to the Owner. Guests shall not remove, relocate, or misuse them. Locked areas are off-limits.
LOST OR LOCKED KEYS
- If keys are lost, the lock and keys will be replaced at the Guest’s expense.
- If keys are locked inside, CadenzaLux will arrange a locksmith, and the Guest shall bear the cost.
MAIL AND DELIVERIES
Use of the Property’s mailbox is prohibited unless expressly authorised.
UTILITIES AND FAIR USE
Utilities are included for normal residential use. Excessive or negligent use (e.g., running air conditioning with windows open) may result in charges.
SMOKING POLICY
All CadenzaLux properties are non-smoking indoors. Smoking outdoors is permitted only in designated areas.
Evidence of indoor smoking will incur remediation charges for cleaning and deodorisation.
PETS
Some properties may allow pets; this must be approved in advance by CadenzaLux or the Owner. Additional fees may apply.
Guests are liable for any damage, nuisance, or neighbour complaints resulting from pets.
PARTIES, VISITORS AND NOISE
No unauthorised guests may stay overnight. Visitors may be permitted during the day with prior consent, subject to local limits.
Loud music, parties, or events are strictly prohibited unless explicitly authorised.
NO COMMERCIAL USE OR SUB- LETTING
The property may not be used for professional activities, filming, photography, or subletting without prior written consent.
MAINTENANCE AND ISSUES DURING STAY
Guests must report maintenance issues immediately. CadenzaLux will use reasonable efforts to resolve reported problems promptly, but timelines may vary if third-party contractors are required.
Guests must allow reasonable access for inspections and repairs.
Failure to report an issue during the stay may void any later claim for compensation.
CLEANING AND CONDITION ON DEPARTURE
Properties must be left in good order and reasonable cleanliness. Excessive dirt, unwashed dishes, or disarray may result in additional cleaning charges.
Guests are responsible for disposing of rubbish in the correct containers.
PERSONAL BELONGINGS
Guests are responsible for their personal property.
CadenzaLux accepts no liability for loss, theft, or damage to personal belongings within or outside the Property.
Left-behind items can be returned at the Guest’s expense.
FALSIFIED RESERVATIONS
Any reservation obtained under false pretences shall be subject to immediate cancellation, forfeiture of payments, and denial of access to the Property.
CANCELLATION POLICY
- Cancellation more than 90 days before arrival: full refund.
- Cancellation between 60 and 90 days: rental voucher equal to 50% of the total rental value.
- Cancellation is less than 60 days before arrival: no refund.

Owners may impose stricter policies, which will be disclosed prior to booking confirmation.
Requests to extend a stay are subject to availability and may be charged at updated rates.
FORCE MAJEURE
CadenzaLux and the Owner shall not be liable for failure or delay in performing obligations where such failure results from circumstances beyond reasonable control, including but not limited to: natural disasters, extreme weather, acts of God, epidemics, strikes, power or water outages, government restrictions, or civil disturbances.
In such cases, CadenzaLux’s liability shall be limited to refunding rental amounts paid for unused nights.
LIABILITY AND LIMITATION
CadenzaLux acts solely as an intermediary between the Owner and the Guest.
Accordingly:
- CadenzaLux is not the principal contracting party and does not own or manage the Properties directly.
- CadenzaLux shall not be liable for loss, damage, injury, accident, or delay arising from any act, omission, or negligence of the Owner or third parties.
CadenzaLux’s total liability, whether in contract or tort, shall not exceed the total rental amount paid for the relevant booking.
THIRD-PARTY SERVICES
Any external or concierge services (e.g., chefs, transport, childcare) are provided by independent suppliers under their own terms.
CadenzaLux does not supervise, control, or assume responsibility for such services.
ACCOMODATION ONLY
Unless otherwise stated, CadenzaLux provides accommodation-only services and does not act as a package-holiday organiser under EU Directive 2015/2302.
POOLS, HOT TUBS, AND SAFETY
Guests acknowledge that pools and hot tubs present inherent risks. Use is entirely at the Guest’s own risk.
Children must be supervised at all times. People under the influence of alcohol, medication, or with medical conditions should refrain from using such facilities.
By using them, the Guest accepts full responsibility for any injury, accident, or loss and releases CadenzaLux and the Owner from any related claim or liability.
NON-AVAILABILITY AND RELOCATION
If a reserved property becomes unavailable due to circumstances beyond control (including damage or force majeure), CadenzaLux will attempt to relocate the Guest to a comparable property.
If no suitable alternative is accepted, all amounts paid (excluding charges for used nights) shall be refunded in full, and no further compensation shall be due.
BREACH AND TERMINATION
CadenzaLux reserves the right to refuse admission or terminate a stay without refund where guests:
- Breach these Terms.
- Cause disturbance or damage; or engage in illegal or unsafe conduct.
In such circumstances, CadenzaLux may immediately remove Guests, secure the Property, and recover costs arising from the breach.
PRIVACY AND DATA PROTECTION
CadenzaLux processes Guest information in compliance with applicable data protection laws, including the EU General Data Protection Regulation (GDPR).
Data is used solely for booking administration, legal compliance, and property management purposes.
GOVERNING LAW
These Terms and all bookings facilitated by CadenzaLux shall be governed by and construed in accordance with Portuguese law.
Any disputes arising hereunder shall be submitted to the competent Portuguese courts, without prejudice to the Guest’s statutory consumer rights.
WRITTEN EXCEPTIONS
Any variation or exception to these Terms must be expressly agreed in writing by CadenzaLux prior to the commencement of the rental period.
ACCEPTANCE
By confirming a booking, the Guest acknowledges having read, understood, and accepted these Terms and Conditions in full.
All Guests agree to comply with them for the duration of the stay.
